Washington, D.C. - The Inter-American Commission on Human Rights (IACHR) condemns the killing of Antonio Calderón Peralta, an LGTBI person, in Guerrero, Mexico.
According to the information received, on June 9, 2012 – two days after a sexual diversity parade in Guerrero – the body of a person was found at the bottom of a cliff, in the city of Chilpancingo, with deep injuries and contusions. The media reported the person was wearing women’s clothes. They also informed that his mother identified him as Antonio Calderón Peralta, 18 years old. Civil society organizations and media reports indicate that this crime took place after seven killings of LGTBI persons in Guerrero since the beginning of this year, in a context of impunity and lack of investigation.
The IACHR reminds the State of its obligation to investigate such acts on its own initiative and to punish those responsible. The Inter-American Commission urges the State of Mexico to conduct an investigation that takes into account whether this murder was committed because of the gender identity or sexual orientation of the victim.
The Commission continues to receive information on killings, torture, arbitrary arrests, and other forms of violence and exclusion against lesbians, gays, and trans, bisexual, and intersex persons. In addition, the Commission notes that problems exist in the investigation of those crimes, which involve, in part, failures to open lines of investigation into whether the crime was committed by reason of the victim’s gender identity or sexual orientation. The ineffectiveness of the state response fosters high rates of impunity, which in turn lead to the chronic repetition of such crimes, leaving the victims and their families defenseless.
The IACHR urges the State to take action to prevent and respond to these human rights abuses and to ensure that LGTBI people can effectively enjoy their right to a life free from discrimination and violence, including the adoption of policies and public campaigns and the amendments necessary to bring laws into line with the inter-American instruments on human rights.
A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for human rights in the region and acts as a consultative body to the OAS in this area. The Commission is composed of seven independent members who are elected in an individual capacity by the OAS General Assembly and who do not represent their countries of origin or residence.

Washington D.C. – La Comisión Interamericana de Derechos Humanos (CIDH) condena el asesinato de Antonio Calderón Peralta, una persona LGTBI, en Guerrero, México.
De acuerdo con la información recibida, el 9 de junio de 2012 – dos días después de la realización de la marcha por la diversidad sexual en Guerrero – fue hallado el cuerpo de una persona en un barranco en la ciudad de Chilpancingo, con heridas profundas y golpes contusos. Los medios de comunicación informaron que estaba vestido con ropas de mujer. Informaron asimismo que su madre lo identificó como Antonio Calderón Peralta, de 18 años de edad.Organizaciones sociales y medios de comunicación indican que este crimen se suma a otros siete asesinatos de personas LGTBI en Guerrero en lo que va del año, en un contexto de impunidad y falta de investigación debida de estos hechos.
La CIDH recuerda que es obligación del Estado investigar de oficio hechos de esta naturaleza y sancionar a las personas que resulten responsables. La Comisión insta al Estado a abrir líneas de investigación que tengan en cuenta si este asesinato fue cometido en razón de la identidad de género o la orientación sexual de la víctima.
La Comisión continúa recibiendo información sobre asesinatos, torturas, detenciones arbitrarias y otras formas de violencia y exclusión contra lesbianas, gays y personas trans, bisexuales e intersex. Asimismo, la Comisión observa que existen problemas en la investigación de estos crímenes, lo que conlleva, en parte, a que no se abran líneas de investigación que tengan en cuenta si el delito fue cometido en razón de la identidad de género u orientación sexual de las víctimas. La inefectividad de la respuesta estatal fomenta altos índices de impunidad, los cuales a su vez propician su repetición crónica, sumiendo a las víctimas y a sus familiares en la indefensión.
La CIDH urge al Estado a adoptar acciones para evitar y responder ante estos abusos a los derechos humanos y garantizar que las personas LGTBI puedan ejercer efectivamente su derecho a una vida libre de discriminación y violencia, incluyendo la adopción de políticas y campañas públicas, así como las reformas necesarias para adecuar las leyes a los instrumentos interamericanos en materia de derechos humanos.
La CIDH es un órgano principal y autónomo de la Organización de los Estados Americanos (OEA), cuyo mandato surge de la Carta de la OEA y de la Convención Americana sobre Derechos Humanos. La Comisión Interamericana tiene el mandato de promover la observancia de los derechos humanos en la región y actúa como órgano consultivo de la OEA en la materia.
