Mexico, 18 April 2012: Death threats against human rights defender Ms Alba Cruz in Oaxaca

On 13 and 14 April 2012 human rights defender and lawyer Ms Alba Cruz was subjected to death threats received to her mobile telephone. Alba Cruz is a human rights lawyer with the Mexican organisation Comitè de defensa integral de derechos humanos Gobixha - Codigo DH (the Committee for the defence of human rights Gobixha). She has been subjected to numerous death threats and episodes of harassment since 2010 due to her representation of victims of torture and abuse which occurred in the Mexican state of Oaxaca in 2006. To date no persons have been found responsible or brought to justice for carrying out the threats and intimidation against Alba Cruz.

On 14 April 2012 Alba Cruz received a text message on her mobile phone which read Empieza ahora putos (It starts now bitches). The previous day, at approximately 2pm, a message arrived to her phone  in which she was warned ... quedas advertida te mueres junto con el por pendejos (... be warned you will die with him you idiots). The message is believed to refer to Mr Marcelino Coache, trade unionist, former political prisoner and torture victim, whom she is currently representing. Prior to this event, on 30 March 2012, Alba Cruz was travelling from a meeting near Oaxaca when a grey truck, with registration plates from Mexico City, with three men on board attempted to hit her vehicle. When she attempted to take a photo of the men, the van sped away.

In the past six months, her client Marcelino Coache has been the victim of harassment, intimidation and defamation for his active participation in social movements in Oaxaca. Minutes after Alba Cruz received the second above mentioned message, Ms Reyna Rivera, wife of Marcelino Coache, received a threatening message on her mobile telephone, which stated: Te lo advertimos se acuerdan o se hacen pendejos, ahora cuidense ya acabaron (We're warning you, either remember or make idiots of yourselves, now take care of yourselves you're finished). On 14 April 2012 Marcelino Coache received a second threatening message.  All of the messages were sent from the same mobile phone number.

Front Line Defenders expresses serious concern for the security of Alba Cruz in light of the threatening text message she received on 13 and 14 April 2012. Front Line Defenders believes that this and previous threats received by Alba Cruz are directly related to her peaceful and legitimate work in defence of human rights activities, in particular the provision of legal advice. Front Line Defenders is concerned at the failure to bring those responsible for threats against Alba Cruz to justice.

Front Line Defenders urges the authorities in Mexico to:

1. Carry out an immediate, thorough and impartial investigation into the death threat received by human rights defender Alba Cruz with a view to publishing the results and bringing those responsible to justice in accordance with international standards;

2. Take all necessary measures to guarantee the security and physical and psychological integrity of Alba Cruz;

3. Guarantee in all circumstances that all human rights defenders in Mexico are able to carry out their legitimate human rights activities without fear of reprisals and free of all restrictions including harassment, intimidation, threats and character defamation.

México, 18 de abril 2012: Amenazas de muerte a la defensora de los humanos derechos Alba Cruz en Oaxaca

El 13 y 14 de abril del 2012, la defensora de los derechos humanos Alba Cruz fue sujeta a amenazas de muerte recibidas por mensaje de texto a su teléfono móvil. Alba Cruz es abogada de los derechos humanos con la organización mexicana Comité de defensa integral de derechos humanos Gobixha - Codigo DH. Ha sido sujeta a numerosas amenazas e hostigamiento desde 2007 debido a su representación a víctimas de la tortura y abuso que ocurrieron en el departamento de Oaxaca en el 2006. Hasta la fecha ninguna persona ha sido llevado ante la justicia ni nombrada responsable por haber llevado a cabo las amenazas e intimidaciones en contra de la abogada Alba Cruz.

El 14 de abril del 2012, Alba Cruz recibió un mensaje de texto a su celular que decía Empieza ahora putos. El día anterior, aproximadamente a las 14:00 horas, recibió un mensaje de texto donde entre otras cosas señalaba: quedas advertida te mueres junto con el por pendejos. Se cree que el mensaje se refiere al Sr. Marcelino Coache, sindicalista, ex-preso político y víctima de la tortura, al que Alba Cruz se representa en la actualidad. Antes de este evento, el 30 de marzo del 2012, Alba Cruz viajaba de una reunión cerca de Oaxaca, cuando un camión gris con placas de matrícula de la Ciudad de México, con tres hombres a bordo, trató de embestir al vehículo de la defensora de derechos humanos. Cuando intentó tomar una foto de los hombres, la camioneta se alejaba.

En los últimos seis meses, el Sr. Marcelino Coache ha enfrentado diversos actos de hostigamiento, intimidación y una campaña de desprestigio en su contra por su activa participación en el movimiento social en Oaxaca. Minutos después de que Alba Cruz recibió el segundo mensaje antes mencionado, la Sra. Reyna Rivera, esposa de Marcelino Coache, recibió un mensaje amenazador en su teléfono móvil, que decía: Te lo advertimos se acuerdan o se hacen pendejos, ahora cuídense ya acabaron.  El 14 de abril Marcelino Coache recibió un segundo mensaje amenazante.  Todos los mensajes provenían del mismo número celular.

Front Line Defenders manifiesta su profunda preocupación por la seguridad de Alba Cruz debido a los mensajes de texto amenazadores recibidos el 13 y el 14 de abril del 2012. Front Line Defenders considera que las amenazas contra Alba Cruz tienen relación directa con su trabajo pacífico y legitimo en la defensa de los derechos humanos, en particular la provisión de consejo legal. Front Line Defenders manifiesta su preocupación a la falta de investigación y sanción a los responsables por las amenazas contra Alba Cruz.

Front Line Defenders insta a las autoridades mexicanas a que:

1. Lleven a cabo una investigación inmediata, exhaustiva e imparcial sobre la amenaza de muerte contra la defensora de derechos humanos Alba Cruz, con el fin de identificar a los responsables, llevarlos ante un tribunal competente e imparcial, y aplicarles las sanciones previstas por la ley internacional;
   
   
2. Tomen todas las medidas necesarias para garantizar de forma efectiva y adecuada la integridad física y psicológica de Alba Cruz;
   
   
3. Aseguren que todos los defensores de derechos humanos en México, desarrollando sus actividades legítimas en defensa de los derechos humanos, puedan operar libremente sin miedo a restricciones ni represalias.
