On 13 June 2012, human rights defender Ms Telma Yolanda Oquelí Veliz del Cid was shot as she travelled home from a peaceful protest. Yolanda Oquelí is the leader of the Frente Norte del Área Metropolitana – FRENAM (Northern Front of the Metropolitan Area), a movement of community members who defend the land from the expansion of mining activities in San José del Golfo and San Pedro Ayampuc, in the Department of Guatemala.
On 13 June 2012, at approximately 6:30pm, Yolanda Oquelí was driving away from a peaceful protest site in the village of La Puya towards San José El Golfo when she was confronted on the road by two men on a motorcycle. One of the men took out a gun and pointed it at Yolanda Oquelí, before she stopped her car, got out and threw herself to the ground. The men fired four shots, three hit the vehicle and one hit the human rights defender on the right-hand side of her body. The bullet lodged behind her liver. She managed to make telephone contact with someone who was able to find her and bring her to the hospital. She is currently in hospital receiving medical attention for her wound.
Local communities have been protesting at El Tambor mining site since March 2012 in order to raise their concerns over the negative environmental impact of the mining activities being conducted by Exploraciones Mineras de Guatemala, S.A. (EXMIGUA). Yolanda Oquelí has filed complaints with the Public Prosecutor’s Office relating to death threats she has received over the last number of months from workers at the mine, EXMIGUA officials and members of the Comisión Presidencial de Derechos Humanos – COPREDEH (Presidential Human Rights Commission).
Front Line Defenders believes that the attempted killing of human rights defender Yolanda Oquelí is directly related to her legitimate and peaceful work in defence of human rights, and is gravely concerned for her physical and psychological integrity and that of other human rights defenders working within FRENAM and who oppose the expansion of mining activities in San José del Golfo and San Pedro Ayampuc, in the Department of Guatemala.
Front Line Defenders urges the authorities in Guatemala to:
- Carry out an immediate, thorough and impartial investigation into the attempted killing of human rights defender Telma Yolanda Oquelí Veliz del Cid, with a view to publishing the results and bringing those responsible to justice in accordance with international standards;
- Take all necessary measures to guarantee the physical and psychological integrity of Telma Yolanda Oquelí Veliz del Cid and her family members, as well as that of all members of FRENAM;
- Guarantee in all circumstances that human rights defenders in Guatemala are able to carry out their legitimate and peaceful human rights activities without fear of reprisals and free of all restrictions.
15 de junio 2012: Tentativa de asesinato de la defensora de los derechos humanos Telma Yolanda Oquelí Veliz del Cid
El 13 de junio de 2012, la defensora de los derechos humanos, Telma Yolanda Veliz Oquelí del Cid recibió un disparo mientras regresaba a casa de una protesta pacífica. Yolanda Oquelí es el líder del Frente del Norte del Área Metropolitana – FRENAM, un movimiento de miembros de la comunidad que defienden la tierra de la expansión minera en San José del Golfo y San Pedro Ayampuc, en el Departamento de Guatemala.
El 13 de junio de 2012, aproximadamente a las 18:30 horas, Yolanda Oquelí se alejaba del sitio de la protesta pacífica en la Aldea La Puya hacia San José El Golfo, cuando se vio enfrentada en el camino por dos hombres en una motocicleta. Uno de los hombres sacó una arma y se lo apuntó a Yolanda Oquelí, ella paró el coche, se bajó del vehículo, y se arrojó al suelo. Los atacantes dispararon cuatro tiros, tres de los cuales alcanzaron al vehículo y uno le impacto a la defensora de los derechos humanos en la zona lateral derecha de su cuerpo. La bala estaba alojada detrás de su hígado. Consiguió ponerse en contacto con alguien por teléfono, quien la encontró y la llevó al hospital. Actualmente se encuentra en el hospital recibiendo atención médica.
Las comunidades locales han estado protestando en la zona de la minería El Tambor desde marzo de 2012, a fin de plantear sus preocupaciones por el impacto ambiental negativo de las actividades mineras realizadas por la empresa Exploraciones Mineras de Guatemala, S.A. (EXMIGUA). Yolanda Oquelí ha presentado denuncias ante el Ministerio Público en relación con amenazas de muerte que ha recibido los últimos meses de trabajadores de la mina, funcionarios de EXMIGUA y miembros de la Comisión Presidencial de Derechos Humanos – COPREDEH.
Front Line Defenders considera que la tentativa de asesinato de Telma Oquelí, está directamente relacionado con su trabajo legítimo y pacífico en defensa de los derechos humanos, y expresa su profunda preocupación por su integridad física y psicológica y la de otros defensores y defensoras de los derechos humanos que trabajan con FRENAM y que oponen la expansión de las actividades mineras en San José del Golfo y San Pedro Ayampuc, en el Departamento de Guatemala.
Front Line Defenders insta a las autoridades guatemaltecas a que:
- Lleven a cabo una investigación inmediata, exhaustiva e imparcial sobre la tentativa de asesinato de Telma Yolanda Veliz Oquelí del Cid con el fin de identificar a los responsables y llevarlos ante la justicia de acuerdo con los estándares internacionales;
- Tomen las medidas necesarias para garantizar la integridad física y psicológica de Telma Yolanda Veliz Oquelí del Cid, su familia y de todos los miembros de FRENAM;
- Garanticen en toda circunstancia que los defensores de los derechos humanos en Guatemala puedan llevar a cabo sus actividades legítimas y pacíficas de defensa de los derechos humanos, sin temor a represalias y libres de toda restricción.
