El 14 abril de 2011 el domicilio de la defensora de derechos humanos y activista de derechos a la tierra, Sra. Zoraida Hernández Pedraza, fue objeto de un intento de ingreso forzado, perpetrado por dos hombres no identificados en momentos en que ella se encontraba en compañía de su familia.  Zoraida Hernández Pedraza es la Presidenta de la Coporación Sembrar, una organización dedicada a trabajar por la defensa de territorios y de restitución de tierras en Colombia y es vocera de varias organizaciones de derechos a la tierra.  Es además vocera del Movimiento Nacional de Víctimas de Crímenes de Estado (MOVICE).

El 14 abril de 2011, aproximadamente a las 7:30pm, dos hombres irrumpieron con fuerza al conjunto residencial donde vive Zoraida Hernández Pedraza.  Alcanzaron a ingresar hasta el balcón de la vivienda y destruir la cerradura de la puerta; sin embargo, debido a otro seguro adicional los intrusos no lograron avanzar más.  Según se informa, el seguro adicional, combinado con los gritos de auxilio de la defensora de derechos humanos y de su familia,  desalentaron a los agresores y los obligaron a huir.  Nos informan que en el momento en que ocurrió el incidente, el sistema telefónica fue suspendido lo que impidió la comunicación inmediata con el personal de vigilancia del conjunto residencial.  Sin embargo, el sistema se restableció unos minutos después de que los hombres lograran huir. Este acto de intimidación contra Zoraida Hernández Pedraza es uno de varios actos de agresión similares llevados contra líderes y organizaciones que adelantan procesos de defensa de su territorio y de restitución de tierras recientemente.

El 3 marzo de 2011, la Corporación Sembrar devolvió las medidas de seguridad proporcionadas por el Estado, un carro blindado y escoltas, debido a su determinación de aceptarlas sólo hasta el momento en que las autoridades colombianas aborden las cuestiones políticas sobre la continuada inseguridad de los defensores/as de derechos humanos en el país.  Las medidas de protección brindadas por el programa del Estado no pueden proteger eficazmente a las personas en riesgo. La Corporación Sembrar y el abogado Sr Jorge Eliécer Molano fueron obligados a aceptar empresas privadas armadas para su protección.  El Gobierno se había comprometido con la Corporación Sembrar a realizar una reunión de alto nivel, para la discusión de seguridad antes del 15 de marzo de 2011, sin embargo esta sigue sin realizarse desconociéndose los motivos del gobierno para ello. 

La Corporación Sembrar acompaña líderes, comunidades y organizaciones que adelantan procesos de defensa de su territorio y de restitución de tierras.  Actualmente acompaña el proceso de retorno voluntario y autónomo de la comunidad de Las Pavas iniciado el 4 de abril de 2011.  Zoraida Hernández Pedraza ha tenido un papel importante en la asesoría a los integrantes de la Asociación de Campesinos de Buenos Aires - ASOCAB, y en la reclamación para ello de las garantías necesarias para el retorno a la Hacienda las Pavas.  En su papel de vocera del MOVICE, ha dado diversas entrevistas publicas sobre la ley de víctimas y restitución de tierras.

Front Line considera que el intento de ingresar por la fuerza en el domicilio de Zoraida Hernández Pedraza tiene relación directa con sus actividades legítimas y pacíficas en defensa de los derechos humanos, en particular por su labor en los derechos a la tierra.

Front Line insta a las autoridades en Colombia a que:

1. Inicien una investigación inmediata, exhaustiva e imparcial sobre el intento de ingresar por fuerza en el domicilio de la defendsora de derechos humanos Zoraida Hernández Pedraza y su familia , con el fin de hacer públicos los resultados y llevar a los responsables ante la justicia, de acuerdo con los estándares internacionales;
2. Tomen todas las medidas necesarias para garantizar que las medidas de protección otorgadas a favor de Zoraida Hernández Pedraza y su familia, sean aumentados de manera que se garantice una protección efectiva de su seguridad e integridad física y psicológica;
3. Aseguren que en toda circunstancia todos/todas los/las defensores/as de los derechos humanos en Colombia puedan llevar a cabo sus actividades legítimas de defensa de los derechos humanos sin temor a represalias, y libres de toda restricción.

On 14 April 2011 the home of human rights lawyer and land rights activist, Ms Zoraida Hernández Pedraza, was subjected to an attempted break-in by two unidentified men while her and her family were present. Zoraida Hernández Pedraza is the President of Corporación Sembrar, an organisation that is dedicated to working for the defence and re-institution of lands in Colombia, and the spokesperson for various land rights organisations. She is also the spokesperson for the Movimiento Nacional de Víctimas de Crímenes de Estado - MOVICE (Movement of Victims of State Crimes).

On 14 April 2011, at approximately 7:30 pm, two men reportedly broke into the residential complex where Zoraida Hernández Pedraza lives. They reached as far as the balcony of her home and broke the lock on the door, however due to additional security on the door the intruders were unable to enter further. It was reported that the additional security, combined with calls for assistance from the human rights defender and her family, deterred the attackers and they fled the scene. It is reported that at the time of the incident the internal phone systems were down, which prevented any immediate communication with residential complex security personnel. However, the system was operational again minutes after the perpetrators had fled the scene. This act of intimidation carried out against Zoraida Hernández Pedraza is one of many incidents of aggression against leaders and organisations involved in land rights in recent times.

On 3 March 2011, Corporación Sembrar relinquished their State-provided security detail, an armoured vehicle and bodyguards, due to their determination that until such time that the Colombian authorities address political issues relating to the continued insecurity for human rights defenders, protection measures provided through the State programme cannot effectively protect those at risk.  Corporación Sembrar and lawyer Mr Jorge Eliecer Molano have had to accept the employment of private armed companies to protect them. The Government had agreed to hold a meeting with Corporación Sembrar to discuss their security before 15 March 2011, however to date no such meeting has been held, with no reason forthcoming for the delay in holding it.

Corporación Sembrar assists leaders, communities and organisations in the defence of their     territories and the reclamation of their lands. It is currently assisting with the voluntary and autonomous return of the lands of the Pavas Community which began on 4 April 2011. Zoraida Hernández Pedraza played a key role in advising the members of Associación de Campesinos de Buenos Aires - ASOCAB (the Peasants' Association of Buenos Aires) in this project, and in demanding the necessary guarantees for them for the return of the Hacienda Las Pavas. Within her role as spokesperson for MOVICE, she has also given public interviews regarding the Victims' Law and the restitution of lands.

Front Line believes that the attempted break-in at the home of Zoraida Hernández Pedraza is directly related to her legitimate and peaceful activities in defence of human rights, in particular her work in relation to land rights.

Front Line urges you to call on the Colombian authorities to:

1. Carry out an immediate, impartial and thorough investigation into the attempted break-in at the home of human rights defender Zoraida Hernández Pedraza and her family, with a view to publishing the results and bringing those responsible to justice in accordance with international standards;
2. Immediately take all necessary measures to ensure that security provisions and services for Zoraida Hernández Pedraza and all members of the Corporación Sembrar effectively guarantee their security and physical and psychological integrity;
3. Ensure that all human rights defenders in Colombia are free to carry out their legitimate human rights work without fear of restrictions or reprisals.
